Permit requirement
Temporary work may not be carried out by just any company. It requires approval from the Federal Employment Agency, for which an application must be submitted.
Wage floors
Lower wage limits must be stipulated in the contract between the personnel service provider and the temporary worker. These must not be undercut. Temporary workers are entitled to the statutory minimum wage.
Maximum transfer period
The so-called maximum duration of temporary employment is limited to 18 months. In plain language, this means that temporary workers may only work for the same company for 18 consecutive months without a break of at least 3 months in between.
Equal Pay
It is often said that temporary workers are paid less than permanent employees. Equal pay in temporary employment therefore means that temporary workers must receive the same salary as permanent employees after 9 months of uninterrupted working time with a company. Special payments or bonuses are also included.
Equality
Temporary workers and permanent employees of the company must have similar working conditions, and the temporary employment agency must ensure this - this is regulated by the principle of equality in the AÜG.
